No Privilege More Prime Than People-Ii

The same creed that cries of injury
Now sits in judgment O as jury!
The plea that ere pained was
Now plays judge in own cause!
Freedom's voice can't be derogatory.

Contempt of court, scandalising it and privilege motions have for long become obsolete in many countries, but not in India. The basic point in such cases is: judges are at once the aggrieved party and juries at the same time, a fundamental infirmity in any law. How can a court play judge in own case? One such case has attracted a lot of public debate (advocate Prashant Bhushan contempt of court case) .This is the second poem in a series.

I completely agree with your observations in this regard. Judiciary has taken a beating and it seems they are abdicating their powers to uphold constitutional propriety. You have rightly said 'judges are at once the aggrieved party and juries at the same time, a fundamental infirmity in any law' as in PB contempt case. Last year, Justice Gogoi adjudicated his own case after being charged with sexual harassment.
